This document describes the rules for using the Shred or Slam mobile app. It is based on the app's current behavior and is not legal advice. Have a qualified attorney review before publication.
By downloading, accessing, or using Shred or Slam, you agree to these Terms and Conditions and our Privacy Policy above. If you do not agree, do not use the app.
You must be at least 13 years old to use the app. If you are under 18, you represent that you have permission from a parent or guardian. You must provide accurate information and comply with applicable laws.
Shred or Slam is a mobile app for discovering skate brands through a vertical swipe feed. The app includes bundled sample brands and user-submitted brands approved for display. Browsing and signing in are free. Creating and managing a brand listing requires an active brand subscription (see Section 5).
User accounts let you browse the feed, report brands, and submit feedback.
Brand accounts let you create and manage a brand listing after purchasing a subscription and completing setup. You must represent a legitimate skate brand and provide accurate information. You are responsible for activity under your account and for keeping your Apple ID secure.
Brand listings require an auto-renewable subscription purchased through Apple's In-App Purchase system:

You agree not to:
You retain ownership of content you submit (including brand text and images). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote that content within the app and related marketing for the service.
You represent that your content does not violate any third-party rights or laws.
Users may report brands for issues with text, images, web links, or other concerns. We may review reports, hide or unapprove brands, or remove content that violates these Terms. Brands receiving sufficient reports may be automatically unapproved. We are not obligated to monitor all content but may act at our discretion.
Brand shop URLs open external websites we do not control. We are not responsible for third-party sites, products, pricing, or transactions. Your use of external sites is at your own risk.
The app, its design, and bundled sample content are owned by [TBD] or its licensors and protected by applicable intellectual property laws. Brand names and trademarks shown in the feed belong to their respective owners.
THE APP AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT BRAND LISTINGS OR EXTERNAL LINKS ARE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [TBD] AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
You agree to indemnify and hold harmless [TBD] and its affiliates from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the app, or your violation of these Terms.
We may suspend or terminate your access for violations of these Terms or for any reason at our discretion. You may delete your account at any time in Account settings. Sections that by nature should survive (including disclaimers, limitation of liability, and indemnification) survive termination.
We may modify these Terms at any time. We will post the updated Terms with a new effective date. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of [TBD], without regard to conflict-of-law principles. Disputes will be resolved in the courts of [TBD], unless applicable law requires otherwise.
